Question: I have a PC 484 Petty Theft from 2 years ago in San Fernando CA, and just got another Petty Theft last week in Van Nuys CA. Will this be a felony petty theft since both are in Los Angeles?
Answer: If the new charge is a PC 484 Petty Theft, it will be charged as a misdemeanor if you only have one prior Theft conviction. There may be another issue if you were still on probation from your first conviction. Call me at 818-336-1384. I regularly handle petty theft cases in both Van Nuys CA and San Fernando CA. If there is a probation violation issue, it would be out of San Fernando CA, although it is possible that it could be transferred to Van Nuys CA to be handled at the same time as the current charge.
