License suspended after arrested for DUI
Question: Why did the officer took my license and issued me suspension after arresting me for DUI in Los Angeles, CA? I thought I was innocent until proven guilty???
Answer: Your license is considered a quasi-civil matter through the DMV and you have the right to request a hearing to fight your license being suspended, but must do so within 10 days of your arrest. Note that the officer should have handed you a 30 day temporary drivers license when he arrested you for DUI and took away your regular drivers license. If you don’t already have an attorney, I highly recommend that you retain one for both the criminal matter and the DMV. See https://www.philhachelaw.com/practice-areas/dmv-hearings/ for more info.
