Question: How long will I need to have a restricted license after a second DUI in Los Angeles County? It was 3 years for my first one. Will this time be even longer?
Answer: There is no 3 year suspension on a drivers license based on a first offense VC 23152 DUI conviction. At most for a 1st time DUI would be a 1 year suspension (if there is a refusal issue, or under 21). Of course, there are certain parameters you need to comply with in order to get your license back (ie. complete alcohol school, SR-22 form, pay reissue fee, potential completion of interlock device requirement if in pilot county…).
On a second offense DUI, generally speaking, there is a 1 year suspension from the DMV (if you lose hearing or fail to timely request one), and the DMV can impose a 2 year suspension based on a 2nd DUI conviction pursuant to VC 13352(a)(3). As long as there are no probation violation or refusal issues, and over 21 years old, you can be eligible for an Interlock (IID) restricted license after 90 days of a hard suspension. Or, without IID, you can get a work restricted license after 1 year. There are some factors that can potentially affect this.
