DUI Defense
DUI cases follow the same court procedure as other Criminal Charges. There are some distinctions though, which is why some criminal defense attorneys do not touch DUI cases.
DUI charges are largely science based. Much of the defense comes from the ability of challenging the initial stop by the officer, challenging the field sobriety tests, and challenging issues with the breath or blood test (or refusal issues if applicable).
I have extensive knowledge in challenging breath and blood test cases. I know the weaknesses in challenging field sobriety tests. And I know case law precedent that can be used to thwart the prosecutors case against you.
Also, when arrested for a DUI, it is important to request a DMV hearing within 10 days of the arrest. If retained in time, I handle that for my clients, as well as other matters with the DMV, and handling the DMV hearing(s) as well.
Although there are many similarities in DUI cases, whether it be an alcohol or drug DUI issue, there are also many variables. Often times people come to me with what appears to be a tough DUI case to challenge, turns out to be a good case to defend. For example, I have gotten DUI charges dismissed in cases with high blood alcohol contents (ie. over a .20 BAC), and in DUI cases with car accidents, to name a couple.
