Question: Will I serve jail time for a DUI violation in San Fernando Court? The citation says 23152(a) and 23152(b).
Answer: It is possible to get jail time if convicted for a DUI. In the very vast majority of DUI cases I handle I am able to get them resolved avoiding jail time. Often times I am able to get the DUI charges dismissed completely or reduced to a lesser offense. That being said, there are a lot of variables to consider, including whether this is a 1st offense DUI, 2nd offense DUI, 3rd Offense DUI, If there was an accident involved, if anyone was injured, if you were on probation, etc.
Then of course there are the details regarding the events leading up to and after the arrest itself. ie. Why were you pulled over, did you do field sobriety tests, breath tests, blood test, etc. Field sobriety tests, breath tests and blood tests can be challenged, and I do a thorough job investing cases, reviewing, and challenging evidence.
