Can I beat a DUI in Los Angeles if I never actually drove?
Question: I was arrested for a DUI in Los Angeles, California, I was with a friend in her car she started getting sick while driving, I told her to pull over. She pulled into a store parking lot. I go in the store to purchase some items and get a bag just in case she feels like vomiting. On the way out of the store a cop approaches me and tells me to lock the car, I was kind of hesitant to do so but he started getting loud. So I complied, I get the keys from my friend and ask her what to do to lock it up. She said I need to turn the car on to raise the windows, so I did. Immediately the cop starts banging on the trunk telling me to turn it off and that I almost hit his car. The vehicle was never in motion. Made us wait there for another cop, but never asked for my licence/registration.
Answer: Sounds like a good case to fight, and yes, potentially beatable based on what you stated. Contact a DUI attorney to discuss the case in more detail. I would be happy to answer any additional questions you may have. Also, time is of the essence as there is only a 10 day window from the time of arrest to request the DMV hearing (if that has not been done already).
