Can I refuse Field sobriety test
Question: Can I refuse a field sobriety test if I am pulled over for a DUI in CA?
Answer:  As long as you are not on probation that would require you to perform sobriety tests (ie.  probation for a prior DUI), then you can refuse to do a field sobriety tests.  Note, if you are under 21, then there are potential consequences for not taking a preliminary alcohol screening test pursuant to VC 13388.  Feel free to call me to discuss further. I am assuming you were arrested for DUI recently?  If you are over 21 and not on probation, then it can be a good thing that you didn’t do any field sobriety tests.
