DUI checkpoints

Question: I was arrested for a DUI recently in Van Nuys, CA at a DUI checkpoint. Are these legal since I was not driving badly? Is it a possible defense to my DUI?

  1. Answer: Although it is legal for arresting agencies to have DUI checkpoints, there are a lot of factors they need to properly meet in order to make the checkpoint valid. If they do not meet these requirements, it is possible to get the DUI charges dismissed even if your Blood Alcohol content level is above a .08. Call me at 818-336-1384 to discuss this further.
