Question:  I need help.  I have a DUI in San Fernando but moving out of state in a couple weeks to Colorado for work.  I have a DUI hearing in November at San Fernando Court.  My paperwork for my dui states that I blew a .18.  Is there any way around having to fly back for the hearings?  Not only do I not want to fly back and fourth, but I am starting a new job and that would create some immediate issues.

Also, if I am convicted, I know there would be some kind of alcohol course I have to do in California.  How can they expect someone to keep coming back to California for alcohol school when I live out of state.  I am assuming this is an issue that comes up from time to time and hoping there is another way around having to keep flying back.

Answer:  I would recommend hiring a private attorney to handle this matter for you. For misdemeanor charges in most cases, I can appear in court on your behalf without you needing to attend. This way you can be in Colorado , and your attorney can handle and resolve your court case in California.

In the event there is a DUI convictiont is possible that a Judge would allow you to do a comparable Alcohol course in Colorado (which would be a part of your sentencing if you are ultimately convicted of a DUI). That is something that will have to be addressed during your case.  There are then some hoops that have to be overcome for DMV purposes, but it can be done.

I would highly recommend contacting a DUI defense attorney to discuss your case in more detail. A 0.18 BAC is high, but there may be some defenses that can come into play in your case to help limit or mitigate consequences.
