Jail time for an extreme DUI
Jail time for an extreme DUI
Question: How much jail time for an extreme DUI in San Fernando, CA? I was arrested the other night in San Fernando for DUI and I did the breath tests and they told me the result was a 2.6 or something like that. They said it was over 4 times the legal linmit. I did not feel drunk to be 4 times over the limit and kept on telling the officers that but they didn’t care. They started getting agressive with me so I kind of gave it back to them…I’m sure that didn’t help much. They kept me in jail for like 12 hours before they finally let me go. I was talking to another officer when I was getting booked because I was very concerned with the case and told her that I don’t think I was drunk and she seemed to agree. She told me to hire a good DUI attorney, so now that’s what I’m doing.
I want to avoid going to jail if that is possible. Is there a chance that I can avoid jail. Does it help that I have a very clean record? Can you help with this? I would like to avoid having to go to trial if possible but still try to get a good deal.
Answer: First, yes, I can help you with this. I have been successful keeping high BAC clients out of jail and I have been successful in getting DUI’s dismissed and reduced to lesser charges in many cases. Defending DUI cases is what I do for a living.
In regards to your case, there are a lot of variables. To confirm, this is a first offense DUI for you? You have no other DUI or wet reckless convictions? Were you in a car accident, or if not, why were you pulled over? Or was it a DUI checkpoint?
Understanding that your first goal is to stay out of jail, it is possible that I can potentially work out a deal to get the DUI charges reduced to a lesser charge without having to go to trial. No attorney can say for sure though, particulaly without working the case first, which takes time, back and fourth for evidence requests, negotiations with prosecutors etc. That being said, I have a very good track record and know the ins and outs of defending DUI cases both at court and the DMV.
