Question: My drivers licenses is currently suspended and I was on probation for a 14601 and I just got another ticket for driving on a suspended license. I know I should not have been driving, but it was just a quick trip to the grocery store. For the most part I have not been driving since I was convicted, but I needed groceries and I needed to get some motrine for my son who has a fever.
I have read about a necessity defense. Is driving to get medication a good enough reason to avoid any issues? I am really nervous because I know the penalty for violating probation can be severe with lots of jail, and I don’t want to go to jail. Plus there is no one to watch my son if I go to jail.
