First DUI with .10 BAC
Question: I got my first DUI in California. After getting arrested I did some balancing tests and answered some questions. The officer then had me blow into a breath machine where I blew a .10 BAC. Although, the officer did not show me the reading, only told me. After getting arrested I submitted a blood test.
What are my chances of getting my DUI charge reduced to a lesser offense?
Answer: First question is, is this your first DUI ever? or just your first DUI in California? That could make a difference in how you are charged (ie. 1st DUI, 2nd DUI, 3rd DUI, Felony 4th offense DUI etc).
There may be several levels to attack your case on, including lack of probable cause to pull you over, unlawful arrest, and attacking the reliability of the breath and blood tests. A lot of those answers depends on the circumstances of your case specifically.
