Question: Are DUI’s filed as misdemeanors or felonies? Does it make a difference in what Court I am in? Mine is in San Fernando Court.

Answer: Usually DUI charges are filed as misdemeanors. There are exceptions, for instance, if this is a 4th or more DUI charge, or there was an accident involving injury (VC 23153), then it can be filed as a felony. Although it can make a difference what court your case is filed in, if you have a first offense DUI in San Fernando court, and there was no accident with injury involved, it will not be filed as a felony.
