Question: Can I be charged with a Felony DUI in Burbank Court if I was the only person injured? There was a passenger but they were not injured.

Answer: First, if it is a 4th or more DUI in 10 years than it can be charged as a felony regardless of injury. Second, even a 1st DUI can be charged as a felony if there are injuries sustained to people other than the driver. In your case, assuming it’s not a 4th or more DUI offense, it sounds like if the D.A. does file the DUI as a felony, a good DUI attorney familiar with Burbank Court can get it reduced to a misdemeanor, then go from there. Call me at 818-336-1DUI to discuss further as I am a Burbank DUI attorney experienced with that court and with DUI defense.
