Question: I came home, and about 30 minutes later an officer showed up at my door and arrested me for a DUI. I had been drinking at home prior to the cop showing up. Is this a legal charge? Now I have a Van Nuys DUI hearing

Answer: It is possible to get arrested and charged in this circumstance, but it becomes a very defensible case. The level of defense may depend on statements that you may have made to the officer, and if there are damaging statements, whether those statements can be suppressed. You should contact a DUI attorney who practices law in your area to discuss your case in further detail. I do not handle cases in Modesto, but I know a few great DUI attorneys in that area. Feel free to call me, and I can get you their info if you would like.
