Drivers license suspension if I won DUI trial?

Question:  I got a Van Nuys DUI a few years ago. I had a DUI Attorney in Van Nuys and we won at trial.  Would there be any suspension on my Drivers license suspension if I won DUI trial?  What would show on my driving record?
Answer: First, congratulations on winning you Van Nuys DUI trial.
In regards to your driving record, there are a lot of possible variations.  Here are a few, but not all possibilities.
If there was no conviction and no suspension based on an APS hearing, then there shouldn’t be any suspension listed on your driving record as there was no action taken against your license.
If you initially lost or failed to request the APS hearing, but won at DUI trial getting an acquittal of the charges, then hopefully your DUI attorney notified the DMV  of this and had the suspension removed from your record.  If you lost the APS hearing on a Refusal allegation, then an acquittal at trial would not retroactively set aside a APS loss even if your attorney notified the DMV of it.  I know, it gets tricky…
If you initially lost or failed to request the APS hearing, and then there was a hung jury at DUI trial that led to a dismissal of the charges (as opposed to an acquittal of the charges), then that would generally not over-ride the APS (ie. DMV hearing) loss and suspension.
It is probably easier to discuss any questions you have over the phone.  Feel free to call me at 818-336-1384 to discuss further.
