Answer: Did the first DUI get resolved yet? or is that case still pending? If the first case did get resolved, then you will also have a probation violation issue which could increase your potential penalty. If there is a second DUI conviction, by statute the penalty can include 96 hours – 1 year in jail, 3-5 years probation, 18 month alcohol class. The max jail time is highly unlikely, but what the prosecutor or court may be willing to offer would depend on your case. For instance, if there were any enhancements such as high BAC, a refusal issue, excessive speeding, accident, etc. There may be other potential penalties as well such as Cal trans, community service, AA meetings, etc. It is possible to get the DUI charges reduced or dismissed, but I would need to know more about your case(s) in order to better assess the situation.
