Question: I was arrested for a DUI in Van Nuys, CA. Does officer credibility really do anything to help me win this case.

Answer: If you can successfully attack the officers credibility, this will help in your defense. There are obviously different levels on which you can attack the credibility of an officer witness, depending on your case. In a suppression motion, the motion would be argued for a Judge to rule on. If certain circumstances, if the motion to suppress is denied, the prosecutor may see the issues they would have to overcome in a jury trial, and may be willing to give a better plea bargain offer. If not, it’s possible to have success in front of a jury where the officer’s credibility is brought into serious question.
