Question: I was arrested for a DUI on ventura blvd., and now have a Van Nuys DUI court date and need a good local van nuys dui attorney. First question…are DUI checkpoints for drunk drivers even legal? They were pulling over a lot of cars for no reason.

Answer: Well, in short, they are legal when they are properly conducted…but they are not always properly conducted. In which case a motion to suppress can be run and the DUI charge potentially dismissed. There are a list of factors they need to follow, including properly publicizing the check point, having a set pattern for how they stop cars, etc. (ie. it is not supposed to be subjective).
