Answer: If you are represented by private counsel, then your attorney can represent you without your presence with your permission at the hearing(s) on a misdemeanor DUI charge. For example, if you retain me to handle your misdemeanor DUI case, I can go to the court date(s) on your behalf so you don’t need to change your work/vacation schedule. If you are being charged with a felony (for example, if this is your 4th DUI in 10 years, it may be charged as a felony), then you would need to appear at the court date with me.
