Question: Is it legal to take away my license before I am convicted of a DUI in San Fernando?

Answer: Yes, assuming it was a CA license (not an out of state license) then the officer has authority to take your drivers license and issue you a temporary license based on a DUI arreste. You or your DUI attorney needs to request a DMV hearing within 10 days of the DUI arrest in order to fight the license suspension, and get you a new temporary license that will be good for a longer extended period of time. There is a lot more to the DMV hearing and the DUI criminal case than can be explained in an email. Feel free to call me at 818-336-1 DUI to discuss further. I would be happy to talk to you about it.
