Question: Is it possible to get jail time for a DUI (23152) charge? I am in San Fernando Court.

Answer: Yes, it is possible which is why it is important to hire an Attorney who handles DUI’s to assist you in this matter.   The maximum amount of potential jail time for  DUI depends on many different factors.  For example, was this a non injury 1st offense DUI  per VC 23152 with no aggravating factors?  If so the maximum jail sentence would be six (6) months.  If this are prior DUI’s involved, injuries, or other aggravating factors the maximum amount of jail time can increase.  If it is a felony DUI than the sentence could include years in prison.   For all DUI charges, there are minimum and maximum penalties, including custody time.
