What can I do after failure to take breath test after being arrested for a VC 23152 DUI?

Question: I was arrested for a DUI in Northridge.  I did the field sobriety tests the Officer asked me to do, then after getting arrested for DUI I did not do a breath test.  What can I do after failure to take breath test after being arrested for a DUI?  The Officer wrote on my ticket VC 23152 (a) DUI.

Answer: Well, the trick would be to fight the refusal charge that is attached to the DUI 23152 charge. There are many potential defenses that can come into play to fight the Refusal enhancement as well as the underlying DUI charge.  To give a more complete answer, I would need to ask a few more questions about the actions leading up to and following the arrest.
