Question: What happens if I am convicted of a DUI with Refusal? I didn’t think I had to do breath test, but now Burbank Court is saying I did.

Answer: Is this a 1st offense DUI? 2nd DUI? etc. Assuming it’s a 1st DUI, if convicted and admitting or found guilty of the refusal allegation, the penalties will include a 1 year drivers license suspension without any option of getting a restricted license.
